This course will investigate the boundary between circuit court and appellate court jurisdiction. We will begin with the methods by which a party may take an appeal even before a civil case is over, including Rule 2-602(b), which requires specific findings by a circuit court. We will discuss the effect of an appeal on a court’s ability to decide post-judgment motions. We will also discuss the vexing question of what, if anything, a circuit court can do with a case once a party has noted an appeal—even an unauthorized appeal. Finally, we will discuss some technical problems of recurring concern in the appellate courts, such as compliance with the separate-document requirement of Rule 2-601(a) and the requirement of a written declaration in declaratory judgment actions. Kevin Arthur TUESDAY, AUGUST 13 Judicial Disabilities 9:00 a.m. – 3:30 p.m. This course will explore the current Maryland Commission on Judicial Disabilities process and recent changes made by the Supreme Court of Maryland through the rule-making process. We will provide a comprehensive understanding of the function and work of both the Commission, Judicial Inquiry Board, Executive Counsel and Investigative Counsel. Judges will leave with an in-depth understanding of Maryland jurisprudence in judicial conduct cases. Judges will have an opportunity to interact with the professionals who work in this arena every day. Coordinator: Hon. Michael Reed
It is the Grass That Suffers: Child Abuse in Custody and Domestic Violence Cases 9:00 a.m. – 3:30 p.m. According to an African proveb, “When elephants fight, it is the grass that suffers.” Judicial officers who preside over child custody and abuse cases should labor to “do no further harm” and to place the child on the best path to recovery and resilience. Completion of this course will ensure that the judicial officer understands the basics of child development and the physical and mental affect abuse has upon child development. A multi-disciplinary panel will detail how child abuse cases are investigated, prosecuted and presented in the courtroom. Judicial officers will learn how forensic interviews are currently conducted and the varied ways children of abuse present during interviews and in courtroom appearances. This course will explore best practices to ensure due process while mitigating the risk of re-traumatizing children involved in custody and abuse proceedings. Coordinator: Hon. Matthew Maciarello
