TUESDAY, DECEMBER 5 Therapeutic Jurisprudence, Treatment & Restorative Justice 9:00 a.m. – 3:30 p.m. This course will examine Therapeutic Jurisprudence and the role of the judge in applying the available behavioral science tools. Our criminal dockets are driven by addiction and mental health problems that are pervasive in our communities. In Maryland, we incarcerate disproportionately more minorities than any other state in the country. Overdose and resulting death rates have been rising since COVID-19, even before the pandemic. Too many children are trapped in an ongoing “stresspool” of conflict between their parents resulting in contentious and sometimes never-ending adversarial hearings in family court. Increasing domestic violence cases often result in an abuse of the legal system. Juvenile dockets reflect multiple repeat offenses, also driven by the same behavioral issues. Large numbers of cases are “closed at intake” without accountability or a resolution of the cause of the problem, even for repeat serious offenses. Criminal dockets are driven by alcohol and drug abuse or dependence, or behavioral health issues including mental health issues that play out in this adversarial process. Judges are called upon to preside over these cases driven by behavioral science-related issues requiring therapeutic intervention. Therapeutic Jurisprudence offers a new dimension to case management and the court process. For many, this approach is difficult. Yet it can be powerfully liberating. The purpose of this course is to provide an overview of the essential principles of a therapeutic approach to judging. Utilizing therapeutic jurisprudence principles, judges can help promote real changes in behavior, save lives, reduce dockets, and increase their job satisfaction. Coordinator/Faculty: Judge Nancy M. The Law of Competency & Criminal Responsibility — A View from Within 9:00 a.m. – 3:30 p.m. “Is the defendant competent? If not, is he restorable? Was the defendant criminally responsible at the time the offense occurred? This course will explore, primarily through the eyes of subject matter experts, how a judge can address these and other issues (and mentally ill defendants, generally) with greater confidence and understanding. Take a tour of a State hospital. Observe/review a mock competency interview with a patient and his doctor. Understand what a doctor does to determine criminal responsibility or to restore competency. Understand what goes into a hospital discharge plan. Gain greater insight on what to do inside a courtroom by understanding what goes on outside of the courtroom at the State hospital.
